These Terms of Service (“Terms”) govern your access to and use of Agent Vault (https://agentcapsule.app) operated by Agent Vault (“we”, “us”). By registering or using the Service, you agree to these Terms and our Privacy Policy.
1. The Service
Agent Vault provides hosted storage and versioning for structured persona capsules, recovery prompt generation, optional single-turn LLM previews, and API checkpointing on eligible plans. The Service is a continuity aid: it does not guarantee that any target model or platform will reproduce a prior agent experience exactly.
2. Eligibility and accounts
You must be at least 16 years old and able to form a binding contract. You are responsible for your account credentials and for all activity under your account. Notify us immediately at support@agentcapsule.app if you suspect unauthorized access.
3. Your content
You retain ownership of persona capsules and other content you submit. You grant us a limited license to host, process, back up, and display your content solely to operate the Service (including generating recovery prompts and previews you request).
You agree not to submit content that:
- Violates law or third-party rights.
- Contains full chat transcripts presented as a substitute for a structured capsule where the product explicitly rejects such uploads.
- Includes malware, spam, or instructions for illegal harm.
- Impersonates another person without authorization.
4. Plans, limits, and fair use
Features and quotas depend on your plan as described on our Pricing page and enforced in the application. We may suspend or throttle use that exceeds quotas or threatens Service stability.
5. Paid subscriptions and Creem
Paid plans are sold through Creem as merchant of record. By subscribing, you also agree to Creem’s applicable checkout and payment terms. Prices are shown in USD unless otherwise stated at checkout. Subscriptions renew automatically each billing period until canceled. Plan changes take effect according to Creem and our integration rules; downgrades may reduce limits on the next period.
6. API tokens and checkpointing
On eligible plans, you may create API tokens to submit structured snapshots. Tokens must be kept secret. You are responsible for any use of your tokens. Tokens may be revoked at any time from the dashboard.
7. LLM preview disclaimer
LLM preview is an optional diagnostic. Output depends on the model, prompt, and provider policies. Preview responses are not stored as a chat product feature. We do not warrant accuracy, safety, or fitness of preview output for any purpose.
8. Prohibited conduct
You may not reverse engineer the Service, circumvent quotas or authentication, scrape other users’ data, resell access without permission, or use the Service to develop competing datasets from our infrastructure.
9. Intellectual property
We own the Service software, branding, and documentation. These Terms do not grant you rights in our trademarks or code except as needed to use the Service.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT RECOVERY WILL MEET YOUR EXPECTATIONS ON ANY MODEL.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.
12. Indemnity
You will defend and indemnify us against claims arising from your content or misuse of the Service, except to the extent caused by our gross negligence or willful misconduct.
13. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or risk to the Service. Upon termination, your right to access ends; we may delete data per our Privacy Policy and retention practices.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country apply. Courts in Delaware shall have exclusive jurisdiction for disputes not subject to arbitration, unless local law requires otherwise for consumers.
15. Changes
We may modify these Terms. Continued use after the effective date of posted changes constitutes acceptance. If you do not agree, you must stop using the Service and cancel any subscription.
